Privacy Policy

This Privacy Policy (hereinafter – "Policy") defines the procedure for the collection, storage, and use of information and personal data within the operations of FOP TYSHCHUK OLHA IVANIVNA (date and registration number in the Unified State Register of Legal Entities and Individual Entrepreneurs: 11.01.2024, No. 2010350000000480700) and users of the website (including its components – web pages) at: https://www.tdhub.com.ua/ (hereinafter – "Site").

The controller and processor of the Site users' personal data is FOP TYSHCHUK OLHA IVANIVNA (date and registration number in the Unified State Register of Legal Entities and Individual Entrepreneurs: 11.01.2024, No. 2010350000000480700) (hereinafter – "TYSHCHUK DIGITAL HUB").

Using the Site (browsing web pages, clicking links, filling out registration forms, applications, questionnaires, etc.) constitutes the user's consent to the collection, storage, and use of information and personal data by TYSHCHUK DIGITAL HUB under the terms of this Policy (i.e., acceptance of this Policy). The Site user confirms that they have been informed of the procedure, purpose, and other conditions regarding the use of personal data in accordance with Articles 6, 8, 10, and 11 of the Law of Ukraine "On Protection of Personal Data." If you do not agree with the terms of this Policy, you must leave the Site immediately.

The user confirms that they have the legal capacity and standing under the laws of their country of residence to consent to the processing of personal data under the terms set out in this Policy or in the relevant questionnaire, registration form, etc., contained on the pages (tabs) of this Site. If the user lacks full legal capacity, they confirm that consent to the terms of this Policy has been provided by parents, guardians, or custodians who possess full civil capacity and are authorized to provide such consent.

Under the terms of this Policy, the user also consents to the processing of questionnaires, resumes, cover letters, registration forms, and similar documents containing personal data (or lack thereof) submitted to TYSHCHUK DIGITAL HUB via the relevant applications and forms on the Site for the purposes of: 1) using the Site (including browsing, etc.); 2) participating in TYSHCHUK DIGITAL HUB events; 3) determining the user's eligibility for TYSHCHUK DIGITAL HUB projects advertised on the Site.

Any reference to "TYSHCHUK DIGITAL HUB event(s)" refers to an event organized by TYSHCHUK DIGITAL HUB or an event organized by another party affiliated with TYSHCHUK DIGITAL HUB as defined by the Tax Code of Ukraine.

This Policy applies only to information collected on the Site. TYSHCHUK DIGITAL HUB is not responsible for the collection and use of personal data of Site users on third-party websites.

1. DEFINITIONS

Use of Personal Data – any actions taken by the data controller to process such data, actions to protect it, as well as actions to grant partial or full rights to process personal data to other parties involved in personal data relations, carried out with the consent of the data subject or in accordance with the law.

Processing of Personal Data – any operation or set of operations performed, whether or not by automated means, in an information system and/or personal data filing system, related to the collection, registration, accumulation, storage, adaptation, modification, updating, use, and dissemination (distribution, sale, transfer), anonymization, or destruction of information about an individual.

Personal Data – information or a set of information about an individual who is identified or can be specifically identified.

Information – any data and/or information that can be stored on physical media or displayed in electronic form.

Data Subject – an individual (Site user) whose personal data is being processed in accordance with the law.

2. COLLECTION OF INFORMATION AND PERSONAL DATA

2.1. When you use the Site, TYSHCHUK DIGITAL HUB collects and processes information collected automatically through the Site, as well as personal data.

2.2. Information collected automatically through the Site:

  1. IP address;
  2. information about the device, including software and hardware details, used to access the Site;
  3. access time;
  4. web browser parameters and settings (User-agent);
  5. information about user interests based on the content on the Site that the user has interacted with;
  6. geolocation data;
  7. cookies. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server. Cookies can be either "persistent" or "session" cookies: a persistent cookie will be stored by a browser and will remain valid until its set expiry date, unless deleted by the user before then; a session cookie, on the other hand, will expire at the end of the user session, when the web browser is closed. Cookies typically do not contain any information that personally identifies a user. However, personal information that we store about you may be linked to the information stored in and obtained from cookies.

2.3. Personal Data. TYSHCHUK DIGITAL HUB collects only the personal data (such as full name, email address, contact phone number, date of birth, gender, social media links, work experience, current and past place of residence, country and location of the organization represented, name of the company/organization represented, average monthly income, profession, marital status, family composition, etc.) that is knowingly and voluntarily provided by the data subject for the purpose of using the Site. In accordance with legal requirements, this constitutes the data subject's consent to the processing of their personal data for the purposes set out in this Policy. TYSHCHUK DIGITAL HUB does not collect any information for which the law imposes specific restrictions, such as information regarding racial or ethnic origin, political, religious, or ideological beliefs, membership in political parties or trade unions, criminal convictions, or data concerning health, sex life, or biometric or genetic data (in accordance with Article 7 of the Law of Ukraine "On Personal Data Protection"). 

3. PURPOSE OF COLLECTING, STORING, AND USING INFORMATION AND PERSONAL DATA

3.1. Information and personal data are collected, stored, and used for the following purposes:

  1. ensure, maintain, and improve the Site;
  2. to provide information to the user upon request;
  3. to receive and process applications, questionnaires, registration forms, etc., as described on the Site pages;
  4. to enter into contracts;
  5. to send the user targeted content (including advertising material) of relevant interest (including ads) provided by the Company or third parties. In doing so, TYSHCHUK DIGITAL HUB assumes no responsibility for the content of materials provided by third parties;
  6. to provide news and information about the Site and the Company's operations that may be of interest to the user;
  7. to personalize and improve service delivery and ensure a tailored approach;
  8. to fulfill any other purposes for which the information was collected.

4. STORAGE AND USE OF INFORMATION AND PERSONAL DATA

4.1. TYSHCHUK DIGITAL HUB reserves the right to allow third parties to provide contextual and other advertisements and to provide analytical services related to the operation of the Site. These parties may use various identifiers to collect information about app usage, including IP addresses, MAC addresses, device, software, and hardware identifiers, time zones, and usage information, including the information set out in clause 2.2 of this Policy. This information may be used by the Company and other parties, among other things, to determine the popularity of certain content, to provide contextual and other advertising, and to better understand user activity on the Site.

4.2. Push notifications. TYSHCHUK DIGITAL HUB may send the user push notifications or alerts while they are on the Site, or via email or the mobile number provided by the user when filling out an application and/or registration form (if applicable) on the Site, to provide information related to the Site, service updates, promotional messages, and other relevant communications.

4.3. TYSHCHUK DIGITAL HUB does not transfer personal data to third parties, except when such transfer is required by law, or upon the user's request or permission. TYSHCHUK DIGITAL HUB recognizes that personal information is a valuable asset and an integral part of an individual's personal non-property rights; therefore, it takes all possible measures to protect the information and personal data voluntarily and knowingly provided by users to the Company.

4.4. By agreeing to the terms of this Policy, the user consents to TYSHCHUK DIGITAL HUB transferring their information to employees, service providers, consultants, and other parties who require access to such information to perform work on behalf of or at the request of the Company, to the extent justified by the nature of such services.

4.5. TYSHCHUK DIGITAL HUB may transfer all personal data collected in accordance with clause 2.3 of this Policy to entities affiliated with the Company and their employees for the purpose of conducting and organizing events, projects, broadcasts, and/or show formats organized by TYSHCHUK DIGITAL HUB and/or the relevant affiliated legal or natural person.

4.6. TYSHCHUK DIGITAL HUB stores and uses information and personal data for the period necessary to provide quality services and for as long as such use is deemed appropriate by the Company.

4.7. TYSHCHUK DIGITAL HUB takes reasonable measures to protect information and personal data from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction.

5. RIGHTS OF DATA SUBJECTS

5.1. The data subject has the right to:

  1. to be informed about the sources of collection, the location of their personal data, the purpose of its processing, and the location or place of residence (stay) of the data controller or processor, or to authorize a representative to obtain this information on their behalf, except in cases established by law;
  2. to receive information regarding the conditions for accessing personal data, including details about third parties to whom their personal data is transferred;
  3. to access their personal data;
  4. to receive, no later than thirty calendar days from the date of the request, except in cases provided by law, a response confirming whether their personal data is being processed, as well as to receive the content of such personal data;
  5. to submit a reasoned request to the data controller objecting to the processing of their personal data;
  6. to submit a reasoned request for the modification or destruction of their personal data by any data controller or processor if such data is processed unlawfully or is inaccurate;
  7. to have their personal data protected against unlawful processing, accidental loss, destruction, or damage resulting from intentional concealment, failure to provide, or untimely provision of data, as well as protection against the provision of information that is inaccurate or harmful to the honor, dignity, and business reputation of an individual;
  8. to lodge complaints regarding the processing of their personal data with the Commissioner or the court;
  9. to seek legal remedies in the event of a violation of personal data protection laws;
  10. to impose restrictions on the processing of their personal data when providing consent;
  11. to withdraw consent for the processing of personal data;
  12. to be informed about the logic involved in automated personal data processing;
  13. to protection against automated decision-making that produces legal effects concerning them.

6. POLICY VALIDITY

6.1. Policy version dated June 27, 2024.

6.2. TYSHCHUK DIGITAL HUB may modify or update parts of this Policy at any time. All changes to this Policy become effective upon their publication. The publication of a new version of the Policy constitutes proper notification of changes to the Policy.

6.3. If any part of this Policy is found to be invalid or unenforceable, the remaining parts shall remain in full force and effect.
