This Privacy Policy (hereinafter the “Policy”) defines the procedure for the collection, storage and use of information and personal data in the course of the activities of Sole Proprietor TYSCHUK OLHA IVANIVNA (date and number of entry in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations (EDRPOU) on state registration – 11 January 2024, No. 2010350000000480700) and the users of the website (including its components – web pages) located at: https://www.tdhub.com.ua/ (hereinafter – the “Website”).

The controller and processor of personal data of the users of the Website is Sole Proprietor TYSCHUK OLHA IVANIVNA (date and number of entry in the EDRPOU on state registration – 11 January 2024, No. 2010350000000480700) (hereinafter – the “TYSHCHUK DIGITAL HUB Company”).

Use of the Website (browsing web pages and links, filling in registration forms, applications, questionnaires, etc.) means that the user gives consent to the collection, storage and use of information and personal data by the TYSHCHUK DIGITAL HUB Company under the terms of this Policy (i.e. it constitutes acceptance of the terms of this Policy). The user of the Website confirms that they have been informed about the procedure, purpose and other conditions of the use of their personal data in accordance with Articles 6, 8, 10 and 11 of the Law of Ukraine “On Personal Data Protection”. If the user does not agree with the terms of this Policy, they must immediately leave the Website.

The user confirms that they have sufficient legal capacity under the laws of the country of which they are a resident to give consent to the processing of personal data on the terms set out in this Policy or in the relevant questionnaire, registration form, etc., posted on the pages (tabs) of this Website. If the user does not have sufficient legal capacity, the user hereby confirms that consent to the terms of the Policy has been given by their parents or legal guardians who have full civil capacity and are authorised to give such consent.

Under the terms of this Policy, the user also gives consent to the processing of questionnaires, résumés/CVs, cover letters, registration forms, etc., which may contain a certain amount of personal data (or not) and which are sent to the TYSHCHUK DIGITAL HUB Company by filling in the relevant applications and forms on the Website, for the following purposes:
1) use of the Website (including browsing the Website, etc.);
2) participation in events of the TYSHCHUK DIGITAL HUB Company;
3) assessment of the possibility of the user’s participation in projects of the TYSHCHUK DIGITAL HUB Company, information about which is posted on the Website.

In each case where the term “event(s) of the TYSHCHUK DIGITAL HUB Company” is used, it means both an event organised by the TYSHCHUK DIGITAL HUB Company and an event organised by another person that is related to the TYSHCHUK DIGITAL HUB Company within the meaning of the Tax Code of Ukraine.

This Policy applies only to information collected on the Website. The TYSHCHUK DIGITAL HUB Company is not responsible for the collection and use of personal data of users on third-party websites.

Where it is necessary to provide such personal data, we indicate the applicable age restrictions. 1. DEFINITIONS

Use of personal data – any actions of the controller related to the processing of such data, actions related to their protection, as well as actions to grant full or partial rights to process personal data to other participants in relations related to personal data, carried out with the consent of the data subject or in accordance with the law.

Processing of personal data – any action or set of actions performed in whole or in part in an information (automated) system and/or in personal data filing systems that are related to the collection, registration, accumulation, storage, adaptation, modification, updating, use and dissemination (distribution, selling, transfer), anonymisation, destruction of information about an individual.

Personal data – information or a set of information about an individual who is identified or can be specifically identified.

Information – any information and/or data that may be stored on physical media or displayed in electronic form.

Personal data subject – an individual (user of the Website) in respect of whom, in accordance with the law, processing of their personal data is carried out.

2. COLLECTION OF INFORMATION AND PERSONAL DATA

2.1. When using the Website, the TYSHCHUK DIGITAL HUB Company collects and processes information that is collected automatically through the Website, as well as personal data.

2.2. Information that is collected automatically via the Website includes:

- IP address;
- information about the device, including information about the device software and hardware, etc., from which access to the Website is made;
- access time;
- internet browser parameters and settings (User-Agent);
- information about the user’s interests according to the materials on the Website that the user has viewed;
- geolocation data;
- cookies. Cookies are files containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and stored by the browser. Subsequently, this identifier is sent back to the server each time the browser requests a web page from the server. Cookies may be either “persistent” or “session”: persistent cookies will be stored by the browser until their expiry date, unless the user deletes them earlier; session cookies, on the contrary, will be deleted after the end of the session with the website or after the browser is closed. Cookies usually do not contain any information that identifies the user. However, the user’s personal data may be linked to the information stored in and obtained from cookies.

2.3. Personal data. The TYSHCHUK DIGITAL HUB Company collects only those personal data (first name and surname, email address, contact phone number, date of birth, gender, links to social networks, work experience, place of residence for a certain period of time and current place of residence, country and location of the organisation represented by the person, name of the company/organisation represented by the person, average monthly income, profession, marital status, family composition, etc.) that are knowingly and voluntarily provided by the personal data subject for the purpose of using the Website. In accordance with the requirements of the law, this constitutes the personal data subject’s consent to the processing of their personal data for the purposes specified in this Policy. The TYSHCHUK DIGITAL HUB Company does not collect any information for which the legislation establishes special processing requirements, such as information about racial or ethnic origin, political, religious or philosophical beliefs, membership in political parties or trade unions, criminal convictions or sentences, as well as data relating to health, sex life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine “On Personal Data Protection”).

3. PURPOSES OF COLLECTION, STORAGE AND USE OF INFORMATION AND PERSONAL DATA

3.1. Information and personal data are collected, stored and used for the following purposes:

- to provide, maintain and improve the Website;
- to provide information to the user upon their request;
- to receive and process applications, questionnaires, registration forms, etc., the details of which are specified on the pages of the Website;
- to conclude agreements;
- to send the user targeted, including advertising, content (materials) of the relevant nature (including advertisements) provided by the Company or third parties. In this case, the TYSHCHUK DIGITAL HUB Company is not responsible for the content of materials provided by third parties;
- to provide news and information about the Website and the activities of the Company that may be of interest to the user;
- to personalise and improve the provision of services and to ensure an individual approach;
- to fulfil any other purposes for which the information was collected.

4. STORAGE AND USE OF INFORMATION AND PERSONAL DATA

4.1. The TYSHCHUK DIGITAL HUB Company may allow third parties to provide contextual and other advertising and to provide analytical services related to the operation of the Website. These persons may use various identifiers to collect information about the use of the Website, including IP address, MAC address, device identifiers, software and hardware information, time zone and usage information, including the information set out in clause 2.2 of this Policy. This information may be used by the Company and other persons, among other things, to determine the popularity of certain content, provide contextual and other advertising and better understand user activity on the Website.

4.2. Push notifications. The TYSHCHUK DIGITAL HUB Company may send push notifications or alerts to the user when the user is on the Website or to the email address or mobile phone number provided by the user when completing an application and/or registration form (if any) on the Website in order to provide information related to the Website, service updates, advertising messages and other relevant notifications.

4.3. The TYSHCHUK DIGITAL HUB Company does not transfer personal data to third parties, except where such transfer is required by law, at the request of the user or with the user’s consent. The TYSHCHUK DIGITAL HUB Company recognises that personal information is a value and an integral part of the personal non-property rights of any individual and therefore takes all possible measures to protect the information and personal data of users voluntarily and knowingly provided by them to the Company.

4.4. By agreeing to the terms of this Policy, the user gives their consent to the TYSHCHUK DIGITAL HUB Company to transfer information about them to employees, service providers, contractors, consultants and other persons who need access to such information in order to perform work on behalf of or at the request of the Company, in the scope justified by the nature of such services (work).

4.5. The TYSHCHUK DIGITAL HUB Company may transfer all personal data collected in accordance with clause 2.3 of this Policy to legal entities related to the Company and their employees for the purpose of organising and conducting various events, projects, programmes and/or show formats produced by the TYSHCHUK DIGITAL HUB Company and/or the relevant related legal entity and/or individual.

4.6. The TYSHCHUK DIGITAL HUB Company stores and uses information and personal data for the period necessary to provide quality services and for as long as such use is deemed appropriate by the Company.

4.7. The TYSHCHUK DIGITAL HUB Company takes reasonable measures to protect information and personal data from loss, theft, misuse and unauthorised access, disclosure, alteration and destruction.

5. RIGHTS OF PERSONAL DATA SUBJECTS

5.1. A personal data subject has the right to:

- know about the sources of collection, the location of their personal data, the purpose of their processing, the location or place of residence (stay) of the controller or processor of personal data, or give appropriate instructions to authorised persons to obtain this information, except in cases established by law;
- receive information about the conditions for granting access to personal data, in particular information about third parties to whom their personal data are transferred;
- access their personal data;
- obtain, no later than thirty calendar days from the date of receipt of the request, except in cases provided for by law, a response as to whether their personal data are being processed, as well as obtain the content of such personal data;
- submit a reasoned request to the controller of personal data objecting to the processing of their personal data;
- submit a reasoned request for modification or destruction of their personal data by any controller and processor of personal data if these data are processed unlawfully or are inaccurate;
- protect their personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of such data, as well as to protect against the provision of inaccurate data or data that defame the honour, dignity and business reputation of an individual;
- lodge complaints about the processing of their personal data with the Ukrainian Parliament Commissioner for Human Rights or with a court;
- use legal remedies in case of violation of the legislation on personal data protection;
- make reservations regarding the limitation of the right to process their personal data when giving consent;
- withdraw consent to the processing of personal data;
- know the mechanism of automatic processing of personal data;
- be protected from an automated decision that has legal consequences for them.

6. VALIDITY OF THE POLICY

6.1. This Policy is in the wording dated 27 June 2024.

6.2. The TYSHCHUK DIGITAL HUB Company may amend or update parts of this Policy at any time. All amendments to this Policy shall take effect from the moment of their publication. Publication of the Policy in a new wording shall constitute proper notification of amendments to the Policy.

6.3. If any part of this Policy is found to be invalid or unenforceable, the remaining parts shall remain in force.
